Debt letter from attorney does not match summons – can I use to my advantage?

I have been dealing with a debt from a surgey last March. To sum up: I paid a bill with a doctor, then out of the blue got another bill from a collections agency 6 months later. They failed to submit the second bill to my insurance, and I don’t even recall getting a copy of the bill from them.

This has gone on and on, and I recently got a letter from an attorney and now a summons for a court date this month. The kicker: The attorney listed the amounts on the letter (around $450 for the bill, and $300 for fees and court costs) BUT totaled it wrong. The total on the letter said $377.65 instead of $777.65. Then of course the summons is correct.

Can I send him a check for $377.65 with a copy of his letter and the amount highlighted and marked “settlement accepted?”

If you have a court date and the summons was served on you then NO, you can’t send
the attorney the money – you now owe $777.65 with the summons – this amount has
already been incurred with the court action – you can ask the court clerk the same question
to verify the total you owe – but it is going to be the same amount
